Ghailani Verdict a Miscarriage of Justice: "

A New York jury delivered a stunning verdict Wednesday. Ahmed Ghailani, an al Qaeda terrorist who conspired to blow up American embassies in Kenya and Tanzania in 1998, was acquitted of more than 280 charges, including one count of murder for each of the 224 people killed in the simultaneous attacks. The jury found Ghailani guilty of only one charge: conspiracy to destroy U.S. government buildings.


The Department of Justice, which moved Ghailani from Guantanamo to New York for the trial, says it is “pleased” with the outcome since Ghailani will face a minimum of 20 years in prison and possibly serve a life sentence.


It is difficult to square the DOJ’s rhetoric with the carnage that was unleashed in Africa more than a decade ago. The man who helped murder more than 200 civilians was acquitted of their murders even though he is obviously guilty.


Let’s review some of the evidence presented at Ghailani’s trial. According to CBS News, government prosecutors presented all of the following facts to the jury:


1. Ghailani and another al Qaeda operative “purchased the used refrigeration truck converted to a weapon of mass destruction in Tanzania.”



2. “Ghailani then obtained some of the oxygen and flammable acetylene gas tanks joined to the TNT to enhance the explosion.”


3. “Ghailani also stored electric detonators - one and a half inch, aluminum coated, PETN charged blasting caps -- in the armoire of his Dar es Salaam house. The FBI found one, along with clothing tainted with TNT residue.”


4. Ghailani gave the suicide bomber who blew himself up in Tanzania the cell phone he used in plotting the attack. The suicide bomber made calls from this phone both the night before, and the morning of, the attack.


5. The government produced “numerous witnesses” who “placed Ghailani in 1998 in the company of known al Qaeda operatives and embassy bombers, at [a] ‘safe house’ in coastal Mombasa, Kenya, at the house Ghailani shared in Dar es Salaam, and riding in utility vehicles the conspirators used to ferry supplies to their bomb making locations.”



CBS News explains that two of the men “seen with Ghailani” have already been convicted for their role in the embassy bombings and are “serving life sentences.”



6. “Ghailani fled Tanzania using a fake name and passport the day before the bombings” and “three senior al Qaeda leaders involved with the East Africa's cell were on Ghailani's flight to Karachi, Pakistan."


It is a mystery how the jury could find that these facts failed to add up to a guilty verdict on all of the murder counts. How can a terrorist be guilty of conspiring to blow up two buildings, but then be found not guilty of the ensuing deaths?


The verdict doesn’t make any logical sense even if there is a lawyerly explanation. (One juror reportedly held out, disagreeing with the other 11 jurors until a verdict was finally reached. It may be the case that the jurors could only agree on a compromise.)


The evidence outlined above is consistent with that which was presented during Ghailani’s combatant status review tribunal (CSRT) at Guantanamo – with one noteworthy exception. Ghailani purchased some of the TNT used in the attacks, but the judge in this case barred the witness who sold the TNT to him. During his CSRT, Ghailani came up with the unconvincing excuse that when he purchased the TNT he thought he was really purchasing “soap for washing horses.”


It does not appear that the jury ever heard this absurd excuse because Judge Kaplan barred the TNT seller from testifying. Ghailani’s lawyers used equally lame excuses in their attempt to explain away the other damning evidence. They portrayed Ghailani as a “dupe” and “naïve” innocent who just happened to take part in al Qaeda’s most successful attack prior to September 11.


Instead of dispensing with Ghailani’s unconvincing story once and for all, the jury waffled. Thus, a terrorist who helped kill 224 people was found “not guilty” of their murders.


No one should be “pleased” with that verdict, even if Ghailani will likely serve many years in prison.

Is Iran’s government sponsoring an Internet site that extols the German Nazis, their history and achievements, including the antisemitism that the current Iranian regime also supports? The facts seems to show this to be true though the possibility of a hoax does exist.



Here are the facts. There is a discussion group site entitled IranNazi that has an Iranian internet URL. It is written in Persian and seems to have begun on August 24. All the material on the site is pro-Nazi and features pictures of Adolph Hitler, the swastika, and goose-stepping German soldiers. There is an English-language part as well.



The main page includes the following message:



این تارنما طبق قوانین جمهوری اسلامی ایران و تحت نظارت کارگروه رسانه های دیجیتال وزارت فرهنگ و ارشاد جمهوری اسلامی فعالیت می کند .



In English it means: 'This website is under Islamic Republic of Iran laws and it is under the supervision of the working committee on Digital Media of the Ministry of Culture and Islamic Guidance.'



Neo-Nazi groups have existed in Iran, going back to the 1930s when some high-ranking Iranians advocated an alliance with Germany. Indeed, fear of such an outcome led to the Anglo-Soviet invasion of Iran in 1941 and five-year-long occupation of the country.



Could this site be a counterfeit created by anti-government forces to discredit the regime or an independent creation of some tiny group? Maybe. But probably not.



The site is registered to this place. IRNIC, the registered holder, is Iran's domain manager and an arm of the government.



So this, then, is a state-backed site, showing just how far the regime has gone in endorsing Nazism and antisemitism.



One reader asked me whether anyone would be surprised to see something like this happen. My answer is that while many observers won't be surprised, given the regime's hatred of Jews as well as of Israel, the national home of the Jewish people, there are others who will be genuinely shocked. The conventional wisdom in many quarters that Iran's regime is a rational government that looks only to its national self-interest.



There is something to be said for this view. We have seen times when Iran's rulers--some if not all--exercised caution and showed that the regime's survival was their highest priority.



But as I've written elsewhere, Iran's government is the closest thing we've seen to an irrational, ideologically motivated ruler since the fall of Germany in 1945. There have been other such rulers--Idi Amin in Uganda, the Cambodian Communists, the Afghan Taliban come to mind. But we have seen how these regimes have behaved and how many people they've murdered.



And none of those others, including Nazi Germany itself, had nuclear weapons.

He worked for Osama bin Laden. He had a blasting cap in his room, and bought the gas tanks used in the truck bomb. And he is acquitted of everything but conspiracy.

NEW YORK -- The first Guantanamo detainee to face a civilian trial was acquitted Wednesday of most charges he helped unleash death and destruction on two U.S. embassies in Africa in 1998 - an opening salvo in al-Qaida's campaign to kill Americans.

A federal jury convicted Ahmed Ghailani of one count of conspiracy and acquitted him of all other counts, including murder and murder conspiracy, in the embassy bombings. The anonymous federal jury deliberated over seven days, with a juror writing a note to the judge saying she felt threatened by other jurors.

Prosecutors had branded Ghailani a cold-blooded terrorist. The defense portrayed him as a clueless errand boy, exploited by senior al-Qaida operatives and framed by evidence from contaminated crime scenes.

The trial at a lower Manhattan courthouse had been viewed as a possible test case for President Barack Obama administration's aim of putting other terror detainees - including self-professed Sept. 11 mastermind Khalid Sheik Mohammed and four other terrorism suspects held at Guantanamo Bay, Cuba - on trial on U.S. soil.

Ghailani's prosecution also demonstrated some of the constitutional challenges the government would face if that happens. On the eve of his trial last month, the judge barred the government from calling a key witness because the witness had been identified while Ghailani was being held at a secret CIA camp where harsh interrogation techniques were used....

Prosecutors had alleged Ghailani helped an al-Qaida cell buy a truck and components for explosives used in a suicide bombing in his native Tanzania on Aug. 7, 1998. The attack in Dar es Salaam and a nearly simultaneous bombing in Nairobi, Kenya, killed 224 people, including 12 Americans.

The day before the bombings, Ghailani boarded a one-way flight to Pakistan under an alias, prosecutors said. While on the run, he spent time in Afghanistan as a cook and bodyguard for Osama bin Laden and later as a document forger for al-Qaida, authorities said....

"This is Ahmed Ghailani. This is al-Qaida. This is a terrorist. This is a killer," Assistant U.S. Attorney Harry Chernoff said in closing arguments.

The jury heard a former al-Qaida member who has cooperated with the government describe how bin Laden took the group in a more radical direction with a 1998 fatwa, or religious edict, against Americans....

A prosecutor read aloud the fatwa, which called on Muslims to rise up and "kill the Americans and plunder their money wherever and whenever they can find it."

Other witnesses described how Ghailani bought gas tanks used in the truck bomb with cash supplied by the terror group, how the FBI found a blasting cap stashed in his room at a cell hideout and how he lied to family members about his escape, telling them he was going to Yemen to start a new life....

"Call him a fall guy. Call him a pawn," lawyer Peter Quijano said in his closing argument. "But don't call him guilty."

Quijano argued the investigation in Africa was too chaotic to produce reliable evidence. He said local authorities and the FBI "trampled all over" unsecured crime scenes during searches in Tanzania.

The verdict came down late today after chaotic deliberations in the  first civilian trial of a GITMO prisoner.  Ahmed Ghailani was found innocent of all but 1 of over 280 charges against him in the bombing of U.S. Embassies in Kenya and Tanzania.

Apparently the evidence charging him with 224 counts of murder could not be used in court because "coercive" techniques were used to get information from him.


The jury did found him guilty of "conspiracy to destroy government buildings" Huh?  So the Muslim terrorist  killed 224 people and he's guilty of ............... destruction of public property? Are we under attack from within or what? 


This is a serious setback for the US - no one can make a case for civilian trials. Another breathtaking Obama failure, yet again putting Americans and national security at risk.

The predictable result of liberal policies
If you read the Detroit headline here you would think it was good news: Michigan's jobless rate edges down again
Unemployment in the state dropped by two-tenths of a percentage point to 12.8 percent in October, making it the first time in 18 months that Michigan's jobless rate has been below 13 percent.
This is anything but good news. Because the unemployment rate is calculated in a way that makes Enron look honest, the rate goes down when people run out of unemployment benefits or stop looking for work. It also decreases when people up and leave the state. In either case, there was no gain in jobs and in fact jobs could have decreased even though the unemployment rate declined. That's exactly what has been happening in Michigan for months. Later in the article, the true scope of what's really bad news surfaces:
According to seasonally adjusted data released todayby the Michigan Department of Energy, Labor & Economic Growth, unemployment edged down by 6,000 in October, and total employment was essentially unchanged, with a drop of 1,000 jobs. The combination of these reductions pushed the state's labor force down by 7,000 over the month.
Translation: 6,000 people exhausted their unemployment benefits or stopped looking for work. They are either on welfare and food stamps of left the state. 1,000 jobs were lost. There are now 7,000 less people working than the month before. Why can't the establishment MSM just spell that out in plain English rather than making bad news sound good? I'm sure that will change when Granholm leaves office and Snyder enters it. The labor participation rate is dropping in Michigan and in fact the nation: Good News: Labor Force Participation Rate Drops To 25 Year Low, At 64.5%. That fact is being covered up by bogus unemployment numbers. Even 60 minutes admitted that the true unemployment rate is at 17% nationally:
Including those that age into the work force but can't find a job, try 19% or more.

Of all the bills that the lame duck Congress may or may not consider, the most dangerous one is the DREAM Act. Harry Reid has vowed to bring this evil law up for a vote in the lame duck session.


The DREAM Act would grant amnesty to any illegal alien who claim that they are:


1. Under 35 years of age


2. Were brought here before the age of 16


3. Have resided here for five years


4. Have a high school diploma


5. Are of good “moral character”


Given that these aliens have been committing fraud and identity theft their entire lives, it should be easy for them to provide the appropriate proofs. For instance, no birth certificate is needed to prove that an alien is under 35. He just needs two affidavits from persons who claim to have knowledge of his birth.


This amnesty would allow at least 2 million illegal aliens to eventually become US citizens. The actual number is likely to be much larger because:


1. All the 20 million illegal aliens in the country would qualify for the amnesty by committing fraud.


This is what happened during previous amnesties for “agricultural workers” and the like. For instance, in 2001 three Israelis were shot dead at LAX airport by an Arab terrorist who had qualified for an “agricultural worker” amnesty.


2. Once these illegal aliens qualified for amnesty, they could sponsor their entire families for US citizenship! Over a million people become American citizens each year, mostly as a result of the 1987 amnesty!


Meanwhile, foreigners who are here in the US legally would not qualify for these benefits!!

Fighting against terrorism, an evil which rejects all the basic moral and legal norms of civilized society, is inherently difficult for liberal democracies such as the United States. It forces the democracy to find the right balance between the protection of civil liberties on one hand with the prevention of violence on the other. It is clear that the latest TSA policy which gives passengers a choice of having your naked picture taken or having your private parts groped by a TSA official is not 'balanced'



Many of the issues in front of our policymakers have previously been faced by Israel, a country that has been under the threat terrorist attack since its inception in 1948. And we keep hearing why can't we run our airport security the same way they do in Israel? The real answer to that question is here in the US personal rights take a back seat to political correctness.



Israeli counter-terrorism efforts have a simple philosophy, “Do whatever it takes to identify and defend against potential attacks before they happen.” This approach does not change whether there is a left or right wing Prime Minister in power, which is a reflection of the continuing public support for the way things are run. For Israel, the fight against terrorism is a fight for its very survival. Thus her government and citizenry take a different view of counter-terrorism, unencumbered by the political correctness which restrains efforts in the United States.



Also understand that anyone who complains that New Yorkers are impatient, has never met an Israeli. Israelis are amongst the most impatient people in the world. Oh they have no problem waiting for an elder person to cross the road, but make them stand in line....no way! So any system that Israeli security developed couldn't make passengers spend any more time at the airport.











In Israel, ethnicity, race and religion is a factor in a profile, as well as general appearance and behavior. And it applied to passengers on outgoing flights, but on people flying into Israel on Israeli airline such as El Al, and wherever the profile is being made, it is being made by Israelis.



The ISA (Israeli Security Agency) calls it “human factor.” Some part of that human factor would cause Al Sharpton to show up to picket the Airport if it was practiced in the US. Ethnic profiling of passengers plays a central role in Israel’s multi-level approach.

All passengers travelling to and from Israel are questioned by security staff. For Jewish Israelis, the process takes a couple of minutes at most, with passengers being asked whether they packed their luggage alone, and whether anyone had access to the luggage once it was packed. Jewish tourists also usually pass through security within a few minutes, particularly if they can speak a bit of Hebrew or are frequent visitors to the Holy Land.
When my family entered the El Al terminal at Newark Airport, we were met by someone who innocently asked us where we came from and where were going. Then when we got into the terminal and were on the line to check in and get our boarding pass, an El Al employee in a jacket and tie nicely asked my 12 year old son (out of my ear's range) why we were going to Israel. As my son and I were wearing yalmukahs our religion was obvious, so the man asked him what synagogue we went to and what was our Rabbi's name. While he was asking questions, he was staring in to his eyes and over my kid's head looking for my wife's reaction as well as mine. The whole thing took no more than thirty seconds, when he was done with my son, he moved up the line and asked me the same questions plus the typical who packed your luggage-type queries, once again gauging my reaction very closely. Then he moved up to the next group and so on.



Like the Mossad, tank drivers, and air force pilots, Israeli airport security have that super hero, no-nonsense, get to the point directness and efficiency. “Who packed your bags?” “What was your bar mitzah portion?” “Why are you even here visiting?” This quick-fire interrogation was strangely reassuring.



Non-Jewish tourists tend to be questioned a bit more thoroughly, and may be grilled over the purpose of their visit and about their accommodation. Questions may be repeated several times in a slightly different format, and family members may be asked the same questions to spot inconsistencies.

However, the procedure for Arabs and Muslims can often be lengthy and irritating, ending with a full body and baggage search. Visitors who have passport stamps from countries hostile to Israel are also questioned intensively in what can be a traumatic experience for the uninitiated.



Some foreign journalists who have arrived from states such as Syria and Iran, usually via Jordan or Cyprus, have had laptop computers and even notebooks confiscated, only to be returned weeks later. Anyone admitting to leaving their luggage at an airport or bus station left-luggage area before check-in will have their suitcases stripped, with each item individually checked and re-packed.



Only when the security staff are convinced that a passenger does not pose a security risk will the person being questioned be permitted to proceed to the check-in desk.



In 2008, Israel’s supreme court rejected a petition presented by a group of disgruntled Israeli Arab citizens, backed by the Association of Civil Rights in Israel, demanding an end to ethnic profiling as discriminatory and illegal.
If I had been more attentive I would have noticed that throughout the terminal there were 'armed eyes' looking at my family as well as everyone else about to get on a plane. These observers where making the same behavioral profiles as the guy in the jacket and tie who asked the questions of the people on line.

'It is mindboggling for us Israelis to look at what happens in North America, because we went through this 50 years ago,' said Rafi Sela, the president of AR Challenges, a global transportation security consultancy. He's worked with the RCMP, the U.S. Navy Seals and airports around the world.


Officers are looking for nervousness or other signs of 'distress' — behavioral profiling. Sela rejects the argument that profiling is discriminatory.



'The word 'profiling' is a political invention by people who don't want to do security,' he said. 'To us, it doesn't matter if he's black, white, young or old. It's just his behavior. So what kind of privacy am I really stepping on when I'm doing this?'
There are other differences, most importantly is that you don't just come off the street and get a job with the ISA (Israel Security Agency). These security agents are all ex-military (as most of the country is) and they are selected based on their intelligence and their ability to behavior profile.







Shlomo Harnoy, vice president of the Sdema group, an Israeli security consultancy firm which specialises in aviation security, believes Umar Farouk Abdulmutallab, the Nigerian who tried to blow up the Detroit-bound Northwest Airlines aircraft on Christmas Day, would have been detained “within seconds ” at Ben Gurion airport. According to Harnoy, a young Muslim travelling alone, on a one-way ticket, with no luggage, was an obvious suspect.
Harnoy, who once headed the Israel Security Agency’s aviation security department, believes investing millions in new technology is not the answer. “Whoever is concentrating on stopping old ladies bringing a bottle of mineral water on to the plane will not find the terrorist, or the bomb. The old lady is not a suicide bomber and the bottle of water is not a bomb component.”



Not only do most Israeli security selectors have degree-level education, they are trained to the highest standards. The most important element in the “human factor” is that the security guards understand the threat.

And of course, on every El Al flight there are armed air marshals on every flight, you won't know who they are, but they know who you are.



As for my families first brush with Israeli Airport Security, we arrived in Ben Gurion Airport twelve hours later, tired but not even realizing that we went through a more extensive security process than we ever had before.







As the United States defends against the ever expanding threat of Muslim terror, right here on our home turf, success depends on throwing off the shackles of political correctness and adopting the methods of our ally Israel.



However the US is stuck in what seems to be an irreversible and deadly policy of treating every one the same. The ultimate result is an airport security process that gives you a choice of being abused by a machine or the groping hands of an untrained TSA agent. The present TSA policies put passengers and the X-Ray appliances that reveal their bare bodies in the same category as they are both treated like machines.



During her 62 year fight against terror, Israel has achieved a balance between protection of civil liberties and the prevention of violence. Her decision was that the sanctity of saving human lives, and preserving personal dignity, outweighs the targeting and possible inconvenient questioning of a few.

Speaking on Meet the Press this week, former congressman and current chairman of the Democratic Leadership Council Harold Ford Jr. said:

I think that there is a sense of who we are, what we represent, and why we’re important to the world. The notion of exceptionalism is thrown around… I think people realize that we’ve built a lot of stuff in this country, we’ve innovated, we’ve lead, and for us to maintain that position, some changes are going to have to come about.

It was only last spring that President Obama explained to a reporter in Strasbourg, France, that American exceptionalism may not be as exceptional as it’s cut out to be: “I believe in American exceptionalism, just as I suspect that the Brits believe in British exceptionalism and the Greeks believe in Greek exceptionalism.” Though the President went on to highlight some of the things that make America extraordinary in his eyes—“the United States remains the largest economy in the world. We have unmatched military capability”—his opening words and subsequent reminder to recognize “the value and wonderful qualities of other countries” essentially amounted to a denial of American exceptionalism.

It is therefore encouraging to see a prominent Democrat like Harold Ford Jr. publicly reembrace the idea of American exceptionalism. The question is whether American expcetionalism boils down to our formidable economic might, as Ford’s remarks seem to suggest?

There is of course no denying that we continue to lead, innovate, and “build stuff”: America’s economy, after all, produces a quarter of the world’s wealth and has been doing so for the past several decades. But must we not look deeper to uncover the true meaning of American exceptionalism? As Matthew Spalding argues in the inaugural essay of Heritage’s Understanding America series:

America is an exceptional nation, but not because of what it has achieved or accomplished. America is exceptional because, unlike any other nation, it is dedicated to the principles of human liberty, grounded on the truths that all men are created equal and endowed with equal rights.

One of these fundamental rights, of course, is the right to acquire and possess property. Prosperous as we may be, we must not lose sight of the fact that our prosperity is the result of our commitment—precarious at times, but sustained nonetheless—to property rights. As Calvin Coolidge noted more than 80 years ago in a speech commemorating the Declaration of Independence: “We live in an age of science and of abounding accumulation of material things. These did not create our Declaration. Our Declaration created them.”

President Obama also admits that there is something exceptional about America’s founding principles. In a part of his answer to the reporter in Strasbourg that has received scant media attention, he went on to note: “I think that we have a core set of values that are enshrined in our Constitution, in our body of law, in our democratic practices, in our belief in free speech and equality, that, though imperfect, are exceptional.”

Whereas the Founders spoke of inalienable rights and self-evident truths, President Obama, good product of our elite universities that he is, gives us mere “values” drained of any permanency. And while he may insist that these imperfect values are exceptional, it is clear that they are not exceptional in the strong sense of the word, flawed as they are. What President Obama gives us is “We hold these imperfect values to be self-evident,” which just doesn’t have the same ring to it, does it?

Harold Ford’s reembrace of American exceptionalism marks a step in the right direction but the Left still has a long way to go to arrive at a sound understanding of the ideas—neither flawed nor changing—that make this country truly exceptional.

But to a Muslim student who overheard it at school on Thursday, it was upsetting. And she had perceived that he had looked at her when he said it, Principal Robert Reis said.



Now the boy is facing a one-day suspension on Monday, because, Reis said, he continued to talk about the incident and it got back to the girl and upset her. Reis said she felt the boy was boasting that he'd gotten away with something.



'This has nothing to do with the fact that the boy used a word,' Reis said. 'This has everything to do with the boy hurt a girl's feelings.' And after the boy was told by administrators not to discuss what happened, Reis said, 'He went back and hurt her feelings a second time.'



But the boy's mother, Rosa Giordano, said the incident 'is totally being blown out of proportion' and she plans to fight the disciplinary action....



'I don't want this on his record as a racial slur and bullying,' she said. 'I am sorry the girl got offended by the world 'Taliban.' I will make sure my son never says the word again ... the poor kid is so upset he doesn't want to go to school.'



Actually, Mrs. Giordano, 'Taliban' is not a race.



Reis said administrators had planned to treat the situation as a teachable moment and meet simultaneously with both students to talk about it. The boy was suspended after the girl came to Reis upset a second time....


'A teachable moment' -- in other words, more Muslim claims of victimhood and evasion of responsibility.

The report cards that arrived home late last week showed few failing grades but instead marks of 'I' for incomplete, indicating that students still owe their teachers essential work. They will get Fs only if they fail to complete assignments and learn the content in the months to come.
Uh - correct me if I'm wrong here, but is this not subprime grading? We'll give you a grade now if you do the work later? And 'in the months to come?' What - 4 months? 6? 12? With this logic in hand, DC school students will get a diploma and turn in work for grades 10, 11 and 12 in the years to come. A deadline will be set to turn in your high school work by the time you're eligible for social security. This is perhaps the the dumbest idea I have ever heard in public education:
And that's saying a lot. Instead of hiding the bad symptoms, how about fixing the problem! What the MSM has done its best to do is to lose this down the memory hole, as it is an utterly shameful act by Obama and Congressional Democrats in deep-sixing the successful voucher program in D.C., dooming 1,800 low-income mostly black students to one of the worst educational systems in the country (the worst is DPS -Detroit Public Schools, which I have bogged about ad infinitum here).

Education secretary Arne Duncan referred to DC public schools as a district with “more money than God.” More than $28,000 per student. Failing miserably. The only success in that district was a voucher program that Obama attacked, even though vouchers cost a quarter (that's right - 25%) of the $28,000 number and helped the students. Should Obama get his head screwed on straight (good luck with that one), he will announce today to all students that since vouchers have been a smashing success in D.C., proved by concrete educational data, they should be a smashing success elsewhere. I mean -wouldn't that be a move to 'restore scientific integrity in governmental decision making?' Especially since vouchers are proven to help students and drive down costs?

But that is not what anyone will hear. That's because Obama and his administration hid data indicating the program's successful educational results as they pushed Congressional Democrats to scrap the program. After all, they have the teachers unions to protect. The WSJ published an article a while back about the shenanigans:

It's bad enough that Democrats are killing a program that parents love and is closing the achievement gap between poor minorities and whites. But as scandalous is that the Education Department almost certainly knew the results of this evaluation for months.

Voucher recipients were tested last spring. The scores were analyzed in the late summer and early fall, and in November preliminary results were presented to a team of advisers who work with the Education Department to produce the annual evaluation. Since Education officials are intimately involved in this process, they had to know what was in this evaluation even as Democrats passed (and Mr. Obama signed) language that ends the program after next year.

Opponents of school choice for poor children have long claimed they'd support vouchers if there was evidence that they work. While running for President last year, Mr. Obama told the Milwaukee Journal-Sentinel that if he saw more proof that they were successful, he would 'not allow my predisposition to stand in the way of making sure that our kids can learn . . . You do what works for the kids.' Except, apparently, when what works is opposed by unions.

Mr. Duncan's office spurned our repeated calls and emails asking what and when he and his aides knew about these results. We do know the Administration prohibited anyone involved with the evaluation from discussing it publicly. You'd think we were talking about nuclear secrets, not about a taxpayer-funded pilot program. A reasonable conclusion is that Mr. Duncan's department didn't want proof of voucher success to interfere with Senator Dick Durbin's campaign to kill vouchers at the behest of the teachers unions.
The decision to let 1,700 poor kids get tossed from private schools is a moral disgrace. It also exposes the ugly politics that lies beneath union and liberal efforts across the country to undermine mayoral control, charter schools, vouchers or any reform that threatens their monopoly over public education dollars and jobs. The Sheldon Silver-Dick Durbin Democrats aren't worried that school choice doesn't work. They're worried that it does, and if Messrs. Obama and Duncan want to succeed as reformers they need to say so consistently.
Ouch. What an absolutely devastating piece. Read the whole thing as it is a very worthy read. There's more and it is equally devastating. There is not enough shame to be heaped on the heads of Democrats for this obscenity of a decision.

UPDATE: A recent Detroit Free Press editorial: Troubled school districts need fundamental changes from state. The freep is a dependable liberal bastion in the MidWest and thus opposes school vouchers instead wanting more money thrown at failed public schools.

Breaking Health Care Research: Repealing Obamacare and Getting Health Care Right

As newly elected lawmakers prepare for the hard work to be done in the next Congress, the future of the hugely unpopular Patient Protection and Affordable Care Act hangs in the balance.

In recent analysis, Heritage expert Nina Owcharenko makes the case for the full repeal of the PPACA and provides a framework for replacement with reform that will transform the system to focus on doctors and patients, not government.  She writes that:

Beyond the unprecedented mandates, new taxes, massive entitlement expansion, unworkable and costly insurance provisions, and its failure to control costs, the new law concentrates enormous power in the U.S. Department of Health and Human Services (HHS). It creates a giant network for the federal micromanagement of health plans, benefits, insurance markets, and unprecedented intervention into the details of health care financing and the delivery of medical care.

Because of these and countless others consequences of the legislation, new and returning Members of Congress must keep up the pressure to overturn the law.  Once this is achieved, it will be time to get health care reform back on the right track towards consumer-focused changes that will address the many issues in the health care system which the PPACA failed to correct.

Owcharenko lists areas for Congress to focus their efforts, including eliminating existing inequitable treatment of health benefits in the tax system, and making Medicare and Medicaid work better for those it currently serves, and expands the states' role in developing customized solutions.  By focusing in these areas, Owcharenko writes that Congress can achieve lasting reform.

Question: Who shows up to a closed-door meeting of power house Democratic supporters and donors?

Answer: Among others, Richard Trumka of the AFL-CIO, Van Jones, and George Soros representative Michael Vachon.

According to Politico, some of the most infamous Democratic backers held a private meeting on Tuesday to discuss strategy in light of runaway GOP victories this fall. The meeting, held at the posh Mandarin Oriental hotel, was organized by the Democracy Alliance, a wealthy liberal group with the goal of building a "progressive infrastructure that could help counter the well-funded and sophisticated conservative apparatus in the areas of civic engagement, leadership, media, and ideas."

Another question: Who is the treasurer of the Democracy Alliance?

Answer: Former Tides Foundation CEO Drummond Pike.

Organizers worked hard to keep the meeting's discussions secret. Off-duty police officers and other security personnel patrolled the halls looking for reporters and other uninvited guests, and promptly escorted them away. But that didn't keep "sources" from talking to Politico.

"The conference itself featured mostly big picture analyses of the midterm elections and their predicted impact on the donors' favored policy causes, rather than strategic planning for the 2012 elections," Politico reports.

But such a meeting would not be complete without discussions of money:

But the source said some donors on the sidelines of the conference discussed whether they should try to match the GOP's outside advertising effort in 2012, and, if so, how to balance that giving with their support for the groups recommended by Democracy Alliance, which focus largely on shaping policy and the media, as well as mobilizing voters around issues.

With that in mind, who else showed up?

There was Erik Smith:

Democratic operatives with experience in advertising campaigns, including Erik Smith, a Democratic operative who worked for the Media Fund in 2004, could be seen mingling with attendees. That group and a linked organization called America Coming Together raised a combined $139 million, much of it from donors now involved in Democracy Alliance, such as Soros, to air ads boosting Sen. John Kerry's unsuccessful Democratic challenge to George W. Bush's reelection.

Smith – who is also executive director of a group called Common Purpose Project, which has received Democracy Alliance support in the past – declined to comment. But another operative who planned to attend the conference told POLITICO that the donors who funded the anti-Bush efforts "told us in 2004 that we couldn't come to them every two years and ask them for $10 to $20 million."

Progressive think tanks:

Among the organizations represented at this week's conference were the watchdog group Citizens for Responsibility and Ethics in Washington, the centrist NDN think tank, Campaign for America's Future, Campaign for Community Change, Advancement Project, Brave New Films, State Voices, and union-related groups that work to mobilize liberal voters, including Working America, Progressive Majority and America Votes.

Businessmen:

Among the donors spotted at the conference on Tuesday, the second day of the three-day gathering, were former Stride Rite chairman Arnold Hiatt, hedge fund financier Donald Sussman, electronics pioneer Bill Budinger, real estate developer Wayne Jordan and Suzanne Hess, the wife of real estate mogul Lawrence Hess.

And even a former Clinton operative:

Other attendees who are influential in liberal politics and policy also milled about Tuesday, including Fitz-Gerald, president of the influential political organizing group America Votes; Robert Borosage, co-director of the Campaign for America's Future; Ellen Dorsey, executive director of the Wallace Global Fund; Matt Ewing, director of a Democracy Alliance-funded project that invests in early stage new media organizations; Philip Dufour, a Washington event planner; Eric Liu, a former speechwriter and deputy domestic policy adviser to former President Bill Clinton; fundraiser Lisa Versaci and radio host Thom Hartman.

So how exactly did Politico obtain all of this information? Sources, as mentioned before, but also first-hand reporting: its writer snuck in before being kicked out by security.

Radical Missouri Senator Claire McCaskill told reporters today, "I am loyal to Obama."
Of course, this was not news to Missouri voters. Democrats sure didn't have to take her in the backroom during the Obamacare vote. McCaskill has ALWAYS been a dependable vote for the Obama-Pelosi regime.
The Hill reported:

Sen. Claire McCaskill (D-Mo.) said she's not "disloyal" to President Obama, but is willing to differ with him and other Democrats when necessary.

The centrist Missouri senator said she believes Obama has done many good things, and sidestepped a fellow Missouri lawmaker's warning that distancing herself from the president would be "an act of disloyalty."

"I am certainly not afraid to oppose the president or members of my party if I disagree with them. But that doesn't mean I'm disloyal to this president," McCaskill said Wednesday during a conference call with Missouri reporters. "I think he was the right choice for our country at the right time. I think many of the things he's done should be admired, and have been good."

GAO: Public Debt Will Surpass WWII Highs Within 10 Years

The Government Accountability Office (GAO) has released yet another dire warning about the nation's long-term fiscal condition. The report—an annual update of long-term budget simulations—projects that debt held by the public will likely exceed the historical high within 10 years.

What was once viewed by many as a distant budget imbalance has suddenly become a near-term crisis. Unfortunately, simply ignoring the issue—the action of choice for most lawmakers to date—exacerbates the problem. The GAO notes the urgency of the situation:

With the passage of time the window to address the long-term challenge narrows and the magnitude of the required changes grows. The federal government faces long-term fiscal pressures that predate the economic downturn and are driven on the spending side largely by rising health care costs and an aging population. GAO's simulations show continually increasing levels of debt that are unsustainable over the long-term. Under [one] simulation, debt held by the public as a share of GDP would exceed the historical high reached in the aftermath of World War II by 2020.

However, this grim fiscal future is not inevitable. Recently, The Heritage Foundation released Solutions for America, a report addressing conservative solutions for 23 discrete policy areas, including 128 detailed policy solutions. Included in the report are five specific ideas to rein in out-of-control entitlement spending and return the nation to a sustainable fiscal course. The recommendations include:

  • Placing entitlements on long-term budgets rather than allowing them to increase indefinitely on auto-pilot,
  • Transforming Medicare into a defined contribution system,
  • Transforming Medicaid from an open-ended entitlement to an insurance-based model of private coverage,
  • Creating a system of voluntary personal accounts within Social Security and transforming the remainder of Social Security to "real insurance," focusing benefits on those who really need them, and
  • Encouraging increased personal retirement savings through auto-enrollment in Individual Retirement Accounts.

The nation's fiscal situation is deteriorating by the day, and previous attempts to "bend the cost curve" have clearly failed. Common sense solutions do exist. It's time to implement real reform.

Paper nor Plastic: L.A. County Bans Plastic Bags, Adds Surcharge to Paper Ones

In Los Angeles county supermarkets and pharmacies, the only plastic soon to be allowed at the checkout is food containers and credit cards. Or in reality, anything but plastic bags.

Tuesday night, the Los Angeles County Board of Supervisors voted to ban plastic grocery bags in areas of the county under its jurisdiction, the LA Times reports.

The ban, which will be in place by 2012, will cover 1,000 stores throughout the county. However it doesn't stop there: the legislation also wants to nudge people away from using paper bags by forcing stores to add a 10-cent surcharge per paper bag used.

According to the Times, "the goal … is to get people to adopt reusable bags made of cloth or durable plastic that can be wiped clean." However, an exception is being made for produce bags.

"Plastic bags are a pollutant. They pollute the urban landscape. They are what we call in our county urban tumbleweed," said County Supervisor Zev Yaroslavsky.

According to one environmentalist, recycling the bags is no longer enough.

"You cannot recycle your way out of the plastic bag problem," Mark Gold, president of the Santa Monica environmental group Heal the Bay, told the Times. "The cost of convenience can no longer be at the expense of the environment."

Not everyone agrees.

"At a time of economic uncertainty, with a large number of businesses leaving our state and community, this would not be an appropriate time … to impose this additional regulation," County Supervisor Michael D. Antonovich said. He was the lone member to vote against the ban.

Coincidence? Soros Apprently Sells Off All Shares of TSA Scanner Company

This week, Mark Hemingway of the Washington Examnier reported that George Soros owns over 11,000 shares of OSI Systems, the parent company of Rapiscan, which manufactures the controversial TSA scanners. But a search today reveals that Soros has divested himself of all those shares.

First, Hemingway's report from Tuesday:

As for the company's other political connections, it also appears that none other than George Soros, the billionaire funder of the country's liberal political infrastructure, owns 11,300 shares of OSI Systems Inc., the company that owns Rapiscan. Not surprisingly, OSI's stock has appreciated considerably over the course of the year. Soros certainly is a savvy investor.

Media Matters, the liberal media watchdog funded by Soros, quickly seized on Hemingway's article and mocked him, saying that 11,3000 shares are only "six one-hundredths of one percent" of the company's total stock. It included the following screen shot showing the investment:

But a funny thing happened between Tuesday and Wednesday: the site detailing Soros's OSIS investments now shows that Soros owns zero shares of the company:

So what happened between yesterday and today? Did the website simply update its information? Did it have the information wrong? Did Soros start feeling the heat and sell off his shares? Hemingway, who first reported the stock holdings, weighs in:

It would be nice if he did this as a response to public pressure, but it seems equally likely that as an investor he simply realized the political tide was turning against the company and the stock may drop as a result.

Either way, it's all very interesting.

No more Red Bull & Vodka: Obama now reaches down our throats

This Administration is getting annoying.  Now they are opening the door to telling us which liquids – all legal unto themselves – can be mixed.  The latest upcoming pronouncement:  Red Bull has caffeine; Vodka has alcohol; thou shall not mix the two.

Hold it, cowpoke (I mean that as a verb).  Are you suggesting that my Irish Coffee (Irish Whiskey – alcohol, and coffee – caffeine) is next?

I will decide what I drink, when I drink it, and how I drink it.  We already have a social compact, criminal laws, and civil liability for DUI.  That's a separate issue.  But if I want to spice up my vodka or gin or run or anything with alcohol by adding a bit of caffeine, I shall make that call.  End of story.

Just wait until the job description for a TSA agent includes the line, "Certificate in Massage Therapy desired but not required."

FOX News Chief Ailes: Obama Has Different Belief System Than Most Americans

Roger Ailes unloaded on Barack Obama and the state-run media in this recent interview with Howard Kurtz. In the interview Ailes calls Obama an unsuccessful socialist… "Even the French and the Germans told him that his socialism was too far left for them to deal with."
Howard Kurtz at The Daily Beast reported:

But Roger Ailes says his network is just reflecting reality when it comes to the White House.

"The president has not been very successful," the Fox News chairman says in a lengthy interview. "He just got kicked from Mumbai to South Korea, and he came home and attacked Republicans for it. He had to be told by the French and the Germans that his socialism was too far left for them to deal with."

The 70-year-old Ailes, dressed in a lavender shirt and tie, goes on in this vein, saying the network isn't singling out Obama for criticism but that its style "tends to be more direct" in challenging presidents. Then he offers this observation about Obama:

"He just has a different belief system than most Americans."

That seems a rather loaded phrase—different belief system—even if you strongly disagree with most of Obama's policies. It fits the view of those who are trying to paint the president as being outside the mainstream. But from the big second-floor office at Fox's Midtown Manhattan headquarters, it's the rest of the media that are using a distorted lens.

"He's had 3,000 press secretaries since he got into office," Ailes says of Obama, but these days, "he's making it harder for the press to make him look good… When the press falls in love, they fall in love hard. They're like teenagers in love. It's like the old Frankie Lymon song, 'Why Do Fools Fall in Love?'"

Ailes brushes aside suggestions that journalists have been much harder on the president as his sliding popularity has led to a Republican takeover of the House. He is far more sympathetic to Obama's predecessor:

"This poor guy, sitting down on his ranch clearing brush, gained a lot of respect for keeping his mouth shut. I literally never heard an Obama speech that didn't blame Bush."
