The Supreme Court today rejected the first preliminary challenge to Obamacare today. They said a federal appeals court has yet to consider the case.
During Elena Kagan's confirmation hearings Republican senators raised concerns about Kagan hearing a legal challenge to the health care law if she was confirmed to the Supreme Court. Today Justice Kagan joined with her fellow justices in rejecting the review.

The Supreme Court has turned down the first preliminary challenge to President Barack Obama's health care overhaul.
The decision Monday to reject an appeal from a former Republican state lawmaker in California was no surprise because a federal appeals court has yet to consider the case. The high court almost never reviews cases before the issues have been aired in lower courts.
Of more significance is the sign that all the justices took part in rejecting the appeal. New Justice Elena Kagan refused to say during her confirmation hearings whether she would take part in the court's deliberations over the health care law. Kagan was Obama's solicitor general before joining the court.
The court has noted Kagan's absence in more than two dozen other cases, suggesting that she voted on the health care appeal.
Kagan has stepped aside from cases in which she was involved as a Justice Department official before joining the court.

Recovery of our majority in the House necessitates new leadership at the top of our party. Nonetheless, one mark of a strong leader is the ability to discern when it is time to pass the baton. As defeated members, whose party needs to rebuild, we are counting on you to show the strength of your leadership in this dark hour. We ask that you step aside as leader of our party in the House. We believe that you can and will play an extraordinary role in our party, and it is extremely unfortunate that Republicans have taken away your ability to lead as effectively as you are able.

The deputy chairman of the company building the Royal Navy's two new aircraft carriers has said the programme is a "disaster" that will make Britain "a laughing stock".
Following last month's defence review, one carrier will only operate for three years and will never carry aircraft. The second will not carry planes until at least 2020.
Anders Fogh Rasmussen, Nato's secretary-general, has warned Britain's defence cuts were "a matter of concern".
But on the bright side, Britain offers "free" third-rate healthcare to taxpayers willing to wait in line for several years. Politics is all about tradeoffs.

U.S. Blows an Opportunity in Shanghai
One of the most disappointing exhibits at Shanghai's Expo 2010, which ended October 31, was the U.S. pavilion — a dismal combination of ineptitude and self-loathing political correctness. As an effort to attract Chinese tourists to the U.S. or improve America's image in China, the pavilion was an epic failure, but as a symbol of Obama's America, it wasn't bad.
The third and final film, "The Garden," was the biggest letdown of all. Granted, it was at least technically proficient, with oblong screens and a few cute effects like misting the audience when it rained on screen. However, content-wise, it was an unmitigated disaster. The film was intended to convey a message that people can work together to make their cities better, featuring a story of a young girl who succeeds in turning a small vacant lot into a garden park after overcoming many obstacles……in the film, a white-collar banker character, in an obvious dig at Wall Street, is the last and most reluctant to support the girl's efforts. It's hard to know where to begin in lambasting this bit of gratuitous capitalist-bashing.
…there was a huge disconnect culturally between the film's message of volunteerism and the reality of life in urban China. In mainland China, NGOs have to be approved by the CCP dictatorship or they just disappear. So advising Chinese people that they should form organizations to beautify their neighborhoods is not likely to be productive. Third, the "garden" in the film was built on a vacant lot; again, this is a scenario that simply has no relevance to urban China. With four times the U.S. population on about the same land area, China has such a huge demand for land that vacant lots barely exist; when they do, they are usually controlled by a property developer and invariably walled off and guarded full-time. Any Chinese attempting to emulate the girl in the film would, therefore, likely be run off by baton-wielding security guards.
DCCC Chairman Rep. Chris Van Hollen admitted to liberal radio host Bill Press that the democrats lost half their geographic territory in last week's election.

Over 1,000 Islamists protested Barack Obama yesterday in Jakarta.

Hundreds of Indonesian Islamists rallied in central Jakarta on Sunday to protest against this week's visit by US President Barack Obama.
More than 1,000 protesters from the radical group Hizbut Tahrir shouted "Obama Comes, We Crush" and "Reject Obama" outside the state palace and the US embassy. They brandished posters bearing his picture and banners with slogans such as "Do not add to Indonesia's grief".
"President Barack Obama until today has continued to colonise Muslim countries like Iraq and Afghanistan and kill our brothers there. As such, we will not accept him as a guest," Hizbut Tahrir spokesman Mohammed Ismail Yusanto told AFP.
"With the disasters happening in Indonesia, his visit will only add to our grief," he added, referring to natural disasters that have taken hundreds of lives in the last few weeks.

Newly-elected Florida Congressman Allen West (R) said that he will "absolutely" join the historically Democratic Congressional Black Caucus when he gets to Washington in January.
"Oh, absolutely right," West told CNN in response to a question of whether he would join. "I think I'm more than qualified. I am a congressmember-to-be, and I am black, so I think that I have every right to be a member of the Congressional Black Caucus. Unless all the sudden before I get there they decide to change the name."

Obviously the president is not a Kenyan. One supposes Mr. Kansagra meant "of Kenyan ancestry" or something.
The not-so-Golden State is borrowing $40M a day from the federal government to pay for unemployment benefits. Currently one of eight workers is unemployed in California.
The AP reported:
With one in every eight workers unemployed and empty state coffers, California is borrowing billions of dollars from the federal government to pay unemployment insurance.
The Los Angeles Times reports that the state owes $8.6 billion already, and will have to come up with a $362-million payment to Washington by the end of next September.
The continued borrowing means federal unemployment insurance taxes are going to increase, upping the annual payroll costs $21 a year per worker.
California tops the list of 32 states that have borrowed a total of $41 billion to pay claims.
The state took out its first loan from the federal government early last year, to deal with rising payment of benefits and number of claims.
Last night, during a taped interview with 60 Minutes, President Barack Obama told Steve Kroft: "I thought the economy would have gotten better by now. One of the things I think you understand as president is you're held responsible for everything. But you don't always have control of everything." President Obama is right: presidents often do get too much of the credit and too much of the blame for the economic performance of the country. But there is one aspect of the economy that President Obama does have control over: taxes. And at a time when our nation's unemployment still hovers around 10%, President Obama's tax plan raises taxes by $1.8 trillion over the next 10 years.
The White House wants you to believe that only the wealthy will pay higher taxes under the President's plan. Don't believe them for a second. These hikes include reducing the child tax credit, re-imposing the marriage penalty, raising taxes on small businesses (the American jobs engine), raising dividend taxes (draining seniors' incomes), raising capital gains taxes (diverting money from job-creating investments) and raising some personal tax rates.
The Heritage Foundation Center for Data Analysis has estimated the impacts of the Obama tax hikes and found they would: 1) decrease inflation-adjusted gross domestic product (GDP) by $1.1 trillion by 2020; 2) decrease business investment by $33 billion a year; 3) decrease personal savings by $38 billion in 2011 alone; 4) decrease consumer spending by $706 billion through 2020; and 5) kill an average of 693,000 jobs a year through 2020. According to a new Rasmussen Reports poll, 58% of likely U.S. Voters say tax increases will hurt the economy while just 18% feel increasing taxes will help our economy. Minority Whip Eric Cantor (R-VA) told Fox News Sunday yesterday: "I am not for raising taxes in a recession, especially when it comes to the job creators that we need so desperately to start creating jobs again. I am not for sending any signal to small businesses in this country that they're going to have their tax rates go up." Conservatives must pay close attention to what this Congress does and be prepared to hold leaders accountable.
