Many in his administration are doing their utmost to subvert America’s well-deserved reputation as an adherent of the rule of law by subordinating it to the dangerous concept that international law, as defined by its high priests, overrides our domestic law, including in the judiciary. What is or is not legally binding about international law, particularly customary international law, is wide open to dispute.


Because democratic debates in constitutional systems like ours are so unsatisfying and often so unproductive for America’s statists, they have, in essence, launched an international power play to move outside of our legal systems. They find much greater prospects for success in international forums like the United Nations than in the U.S. Congress.


The most visible, immediate impact of President Obama’s fascination with international law appears in the global war against terrorism, a term he tries to avoid. Instead, he adopted the view widely held in Europe and among legal theorists that terrorist threats and attacks should be treated under the criminal law enforcement paradigm, rather than as attacks on America subject to the law of war.


Why we should defer to international norms on terrorism is, to say the least, unclear. The U.N. has repeatedly tried and failed to reach a comprehensive definition of terrorism.


The administration has yet to say, for example, that it will oppose potential European efforts to prosecute those responsible for enhanced interrogation techniques. This devotion to international norms is designed to intimidate U.S. decision makers, military forces, and intelligence agents, and violates basic democratic precepts that we are responsible for and fully capable of holding our government to its responsibilities under our Constitution.


In fact, limiting America’s military options and capabilities through international agreements and organizations is a high priority for the Obama administration.


This is not the view, however, of those who want to constrain our sovereignty. After all, if we decided what is right and wrong, they couldn’t second-guess us and bend us to their views. Having failed to win this point within our political system, however, they simply retreat into international organizations, hoping they and their international leftist allies can win there what they failed to win at home.

Obama called the dishonorable Pima County Sheriff Clarence Dupnik today to thank him.


This was after the sheriff made a fool of himself by blaming Rush Limbaugh, tea partyers and conservatives for the acts of a crazy man.


The Political Punch reported:


President Obama spoke today with Pima County Sheriff Clarence Dupnik, families of some of the victims, Rep. Giffords’ Rabbi and two of the heroes that helped in the Arizona tragedy on Saturday.


In a phone call this afternoon with Sheriff Dupnik, according to White House spokesman Nicholas Shapiro, the President “thanked him for his department’s efforts to respond to this incident and coordinate with the FBI and Director Mueller on the investigation.”


Additionally the president also spoke with Patricia Maisch and Roger Salzgeber, two of the heroes from the shooting.


Of course, the fact that Obama would call and personally thank this sheriff who has been wrong on everything since the tragedy started surprises no one.

The big news out of a majority of state capitols is that Obamacare’s Medicaid mandates will exacerbate state budget problems and drive many states to the brink of insolvency.


Thirty-three Republican governors and governors-elect have signed a letter to the White House and Congress making an emphatic appeal that Obamacare’s Medicaid provisions be repealed.


Medicaid pays health care and long-term care expenses for certain categories of individuals. Medicaid has many problems, but the central one is that it costs taxpayers nearly $400 billion annually without providing recipients a high quality of care.


National spending on Medicaid has more than quintupled over the past two decades, and about 16 percent of the population is currently enrolled. A recent study from the University of Virginia found that Medicaid patients have worse surgical outcomes than individuals without insurance. Despite these problems, Obamacare relies heavily on the Medicaid program to reduce the number of individuals without health insurance.


Obamacare’s Medicaid mandates include a requirement that states maintain current program eligibility along with a required Medicaid expansion that is expected to increase national enrollment by around 20 million. If a state reduces eligibility for Medicaid, it will lose all its federal support for the program, which is at least half of every state’s Medicaid spending. This means a state would lose the federal tax contributions its taxpayers send to Washington that eventually return to the state in the form of Medicaid reimbursement.


“States are unable to afford the current Medicaid program, yet our hands are tied by the maintenance of effort (MOE) requirements,” the governors wrote. “The effect of the federal requirements is unconscionable; the federal requirements force governors to cut other critical state programs, such as education, in order to fund a ‘one-size-fits-all’ approach to Medicaid. Again, we ask you to lift the MOE requirements so that states may make difficult budget decisions in ways that reflect the needs of their residents.”


Although the letter was signed by only Republicans, Medicaid is at least as much of a concern in blue states. For example, the new governor of New York, Andrew Cuomo, has proposed cutting $4 billion of projected spending on Medicaid (this savings will be split between the state and the federal government) to help close a $10 billion budget gap.


How will states reduce Medicaid spending, given that they are prevented from reducing program eligibility? There are two primary options: (1) reduce provider payment rates, and (2) cut program benefits. Almost all states have undertaken these actions over the past several years. Reducing payment rates decreases the number of providers who accept Medicaid recipients. Cuts to Medicaid benefits, which are often more generous than those offered by private insurance, have also occurred. The combination of these cuts will likely reduce quality of care and increase the number of recipients who head to emergency rooms for basic care.


Of course, states could keep their Medicaid programs in tact and take the scalpel to other budget items, such as education, transportation, or law enforcement, which are also being cut in many states. Or they could dramatically increase state taxes. How do these options sound?


The one option that should be off the table is a continuance of the federal Medicaid bailout, which was enacted as part of the February 2009 stimulus bill. This provision greatly increased the federal contribution toward state Medicaid spending and disproportionately benefited states with the most bloated programs. The country cannot afford to further increase the national deficit to fund the broken Medicaid entitlement. Instead of throwing more money at Medicaid, policymakers at the federal and state level should grapple with its structural problems.


Medicaid is desperately in need of reform at the federal and state levels, not expansion. States have different characteristics and priorities and need greater flexibility to tailor the Medicaid program to their own specifications. This is true of states with Republican and Democratic governors. This Congress should seriously consider the immediate budgetary concerns of the states as well as structural reforms that would improve care for beneficiaries and reduce taxpayer burden in the longer term. In fact, states should also demand greater flexibility from the federal government in terms of eligibility, benefits, cost sharing, and overall administration and management.

Traditionally, secretaries of the Navy get the honor of naming warships in America’s Naval fleet. But Navy Secretary Ray Mabus is running into stiff opposition over his latest pick: the late Pennsylvania congressman John Murtha.

“Both in uniform and in the halls of Congress, Chairman Murtha dedicated his life to serving his country both in the Marine Corps and Congress,” Mabus said last spring following Murtha’s death. “His unwavering support of our sailors and Marines, and in particular of our wounded warriors, was well known and deeply appreciated.” Murtha was awarded two Purple Hearts during his service in Vietnam and served Pennsylvania’s 12th Congressional District from 1974 until his death last year.


But Mabus’ praise for Murtha is falling on the deaf ears of a number of former sailors and Marines who say naming a vessel for Murtha simply rewards a lawmaker who called for pulling U.S. troops out of Iraq during the height of war’s toughest fighting. Many veterans also point out that Murtha was also implicated in bribery schemes and engaged in much-criticized pork-barrel politics. Last Friday, one of Murtha’s former aides was sentenced to serve 27 months in prison for evading limits on campaign donations. Additionally, Murtha was named as an “unindicted co-conspirator” in the FBI’s 1980 Abscam sting.


What’s worse, sailors and Marines say, in 2006, Murtha claimed that Marines in the Iraqi city of Haditha had “killed innocent civilians in cold blood.”


“Name a ship after a congressman who disgraced himself by rushing to judge that fellow Marines had committed murder in Iraq? Can you be serious?”one retired Marine major general remarked to TIME.


Facebook groups have cropped up online protesting the Navy Secretary‘s decision and more than 200 people voiced their complaints in comments to the Navy’s announcement. Not a single person voiced support for the decision, TIME notes. “As active duty lieutenant commander, I would resign my commission before accepting orders to this misnamed ship,” one officer posted anonymously on the Navy’s website.


Minority Leader Nancy Pelosi has voiced her support of “our dear Jack” and a USS Murtha:


“Whether on the battlefield, or on the bedside, he thanked them for their courage, listened to their concerns, and asked them for comment — and he answered their needs, and responded to their calls, whether it was for body armor, up-armored vehicles… radios, you name it,” Pelosi said. “In those minutes [together], he bonded with them especially because he would share his own personal military service with them, and cared for them as a father. They knew it, and they returned his respect.”


But from sailors’ point of view, the story of the 19-term congressman is a very different account. On the Navy’s official website, many have decried the decision to name a ship after Murtha as a “slap in the face,“ ”inappropriate,“ and ”an absolute disgrace.”


“The naming of LPD 26 after John Murtha is inappropriate,” wrote David Martin. “There [are] many men and women with greater records of valor and service to the country who deserve the honor of having a warship named in their memory before John Murtha has a warship [named] in his honor. He made sure there was an airport named after himself. What more does there need to be?”


In addition, letters in the January issue of the independent naval magazine Proceedings also voiced opposition.


“The Navy’s scheme for naming ships, especially capital ships like carriers and subs, has become a joke,” writes Douglas Pauly, recalling when carriers were named for battles, battleships for states, cruisers for cities, destroyers for people, and submarines for marine life. Traditionalists like the convenience of such categories, where knowing the name of a vessel instantly declares what kind of ship it is.


TIME notes that in naming a ship for Murtha, Mabus is breaking with the old tradition of naming a San Antonio class ship after a U.S. city. Work on the Murtha has begun and a spokesman for the Navy Secretary says Mabus has no intention of reversing his decision to honor the late congressman.


He believes that “the naming honors Congressman Murtha’s lifetime of service to the Marine Corps, in Congress and to our nation.” Of course, sailors and Marines, used to being ignored by the brass, are coming up with their own names for the Murtha. Right now, USS Cold Blooded Killers seems to be their top choice.

Understandably, news of French President Nicolas Sarkozy’s visit to the United States has been overshadowed by the events in Tucson. So when during a joint press conference yesterday Barack Obama slipped into diploma-speak and said “we don’t have a stronger friend and stronger ally” than France, not many people picked up on it. But some did — especially those in Britain.


“We don’t have a stronger friend and stronger ally than Nicolas Sarkozy, and the French people,” Obama said while seated next to the French president. The admission comes at 2:40 below:



To be fair, it could just be a case of inflated praise regularly poured on visiting dignitaries. While we may not have a “stronger” ally, maybe all our allies are equally as strong. But that’s not how some in Britain are interpreting the comment.


Headlines in some British news outlets show the president’s statement raised more than a few eyebrows. The Daily Mail put it this way:



While the Telegraph commented:



“Quite what the French have done to merit this kind of high praise from the US president is difficult to fathom, and if the White House means what it says this represents an extraordinary sea change in US foreign policy,” political analyst Nile Gardiner writes in the Telegraph. “Nicolas Sarkozy is a distinctly more pro-American president than any of his predecessors, and has been an important ally over issues such as Iran and the War on Terror. But to suggest that Paris and not London is Washington’s strongest partner is simply ludicrous.”


Gardiner is especially flummoxed by the statement considering Sarkozy has previously called Obama “thin skinned and authoritarian.” He’s also puzzled considering the amount of troops Britain has committed to current American conflicts in comparison to France:



Today in the war against the Taliban there are more than 10,000 British troops fighting alongside their US allies, compared to 3,850 Frenchmen. Nearly 350 British soldiers have laid down their lives in Afghanistan in contrast to French losses of 53.



Gardiner has noticed other anti-British actions coming from the Obama administration in the past. He’s even outlined the top 10 snubs.


“These kinds of presidential statements matter,” Gardiner adds. “No US president in modern times has described France as America’s closest ally, and such a remark is not only factually wrong but also insulting to Britain, not least coming just a few years after the French famously knifed Washington in the back over the war in Iraq.”


Gardiner isn’t the only one.


“I’m getting a bit fed up with the American President using terms like ‘best ally’ so loosely,” Tory politician Patrick Mercer told the Daily Mail. “It’s Britain that has had more than 300 servicemen killed in Afghanistan, not France.”


“That to my mind is a lot more powerful than any political gesture making.”

The Obama administration is not known for its pro-British track record, but this is by far the strongest indication yet that the current White House has little regard for the Special Relationship and its unique role in modern American history. During a White House photo-op with French President Nicolas Sarkozy, President Obama had this to say:


We don’t have a stronger friend and stronger ally than Nicolas Sarkozy, and the French people.


Quite what the French have done to merit this kind of high praise from the US president is difficult to fathom, and if the White House means what it says this represents an extraordinary sea change in US foreign policy. Nicolas Sarkozy is a distinctly more pro-American president than any of his predecessors, and has been an important ally over issues such as Iran and the War on Terror. But to suggest that Paris and not London is Washington’s strongest partner is simply ludicrous. And rather hypocritical after it was recently revealed that the US Ambassador to France had described Sarkozy as “thin-skinned and authoritarian.”


The French president himself is no doubt bemused by President Obama’s warm embrace, not least after making clear his own less than flattering views of his US counterpart in the past. As The Times reported in the early months of the Obama presidency, Sarkozy clearly sees Obama as lacking experience and suffering from delusions of grandeur.


On the US President, Mr Sarkozy said: “Obama has a subtle mind, very clever and very charismatic. But he was elected two months ago and had never run a ministry. There are a certain number of things on which he has no position. And he is not always up to standard on decision-making and efficiency.”


In another swipe at the American leader, Mr Sarkozy was quoted… making a dubious joke about the Obamania sweeping the European media. According to L’Express news magazine, Mr Sarkozy talked to another set of visitors about Mr Obama’s planned visit to the Normandy beaches in June, Mr Sarkozy said: “I am going to ask him to walk on the Channel and he’ll do it, you’ll see.”


There is of course no comparison between the extremely close-knit relationship between the United States and Great Britain, from defence and intelligence ties to economic investment and cultural exchange. It is an alliance forged over the course of 70 years, from the beaches of Normandy to the battlefields of Afghanistan. Today in the war against the Taliban there are more than 10,000 British troops fighting alongside their US allies, compared to 3,850 Frenchmen. Nearly 350 British soldiers have laid down their lives in Afghanistan in contrast to French losses of 53.


These kinds of presidential statements matter. No US president in modern times has described France as America’s closest ally, and such a remark is not only factually wrong but also insulting to Britain, not least coming just a few years after the French famously knifed Washington in the back over the war in Iraq.


Perhaps the White House would like to confirm that this is what the President of the United States firmly believes, or clarify the comments? Either way, this latest remark from Barack Obama will only further strengthen the impression of a president who is both woefully out of his depth on the world stage, as well as contemptuous of traditional friends and alliances.

President Obama’s oil spill commission will release its long-awaited final report this morning, recommending new government regulations and limits on drilling. These conclusions could shape the future of the oil industry — and impact our nation’s energy policy for years to come.


The commission’s primary focus was determining the cause of the spill. Last week it revealed that errors by BP, Transocean and Halliburton contributed to the blowout of the Macondo well, resulting in the deaths of 11 people and the worst spill in history.


But the commission’s members have decided to go a step further. The anti-drilling measures recommended in their report would take America in the wrong direction. This shouldn’t come as a surprise. Obama picked five members who lack expertise in drilling and have a history of donating to Democrats. One member leads the Natural Resources Defense Council.


Expect liberals to seize on the report to condemn the industry as a whole and renew their attacks on offshore drilling. But the fact is that mistakes of individual actors should not result in punishment for an entire industry.


The American people deserve better. With energy needs on the rise — and gas prices inching higher — now is a time for solutions. The first step is putting an end to the Obama administration’s anti-drilling policy in the Gulf of Mexico. Just two new deep-water permits have been issued since the politically motivated moratorium ended three months ago. That’s down 88 percent from the historical average. Shallow-water permits, which weren’t even subjected to the moratorium, are down 11 percent.


Ongoing delays in the Gulf of Mexico are only part of the problem, however. Offshore drilling bans currently prevent exploration in about 85% of our coastal waters. Those bans are crippling job creation and making America more reliant on foreign sources of oil.


Unfortunately, they were recently reinforced by the Obama administration. The Interior Department announced last month that the eastern Gulf of Mexico and the Atlantic and Pacific coasts would be off limits for the next seven years. That news came after the administration canceled four pending lease sales in Alaska.


The oil industry has much to contribute to America’s energy needs — particularly in light of rising gas prices. The American Petroleum Institute, in its “State of American Energy” report, estimated the industry supports more than $1 trillion in annual contributions to the U.S. economy. Creating additional access to areas currently closed to development would lead to even more domestic production, new jobs and billions in government revenue.


Yet the administration’s actions are having the opposite effect: The lack of exploration and production means fewer jobs for out-of-work Americans and less money flowing into federal coffers.


For the first time since 1959, the United States could go an entire year without a lease sale. That means the loss of more than $1 billion in bonus bids, less revenue from rental payments and significantly fewer royalties. State governments, already grappling with fiscal problems of their own, could forfeit upwards of $100 million in tax revenue, according to Louisiana State University finance professor and economist Joseph Mason.


In addition to its anti-drilling recommendations, the commission will also suggest reforms to the offshore oil and gas liability regime. In the wake of the spill, The Heritage Foundation proposed a liability and claims process that assigns risk of offshore oil and gas operations, compensates victims and protects companies from frivolous lawsuits.


With renewed attention on energy issues, now is the time for Congress to abandon policies and regulations rooted in Washington that lead to higher gas prices, energy shortages and job losses. Instead, lawmakers should turn their attention to common-sense solutions that focus on the free market and entrepreneurial spirit of the private sector.

Reality of North Korea Nuclear Threat Demonstrates Need for Missile Defense: "

Two modified Standard Missile 2 (SM-2) Block IV interceptors are launched from the guided-missile cruiser USS Lake Erie (CG 70) during a Missile Defense Agency test to intercept a short-range ballistic missile target June 5, 2008 in the Pacific Ocean west of Kauai, Hawaii. The missile, one of two launched, intercepted the target approximately 12 miles high on the Pacific Missile Range Facility. This was the second of two successful intercepts of the sea-based terminal capability and the fourteenth overall successful test of the Aegis Ballistic Missile Defense Program.


According to a report in The New York Times, Defense Secretary Robert M. Gates said on Tuesday that North Korea is becoming “a direct threat to the United States” and was within five years of developing a missile with the potential of hitting Alaska or the West Coast. The Times adds: “Mr. Gates’ new assessment on North Korea is a significant shift for the Obama administration, which until now has viewed Pyongyang as a proliferation threat, fearing that it might sell its existing missiles and nuclear devices to other countries, like Iran.”


This is a welcome admission by the Obama administration. Heritage Foundation Northeast Asia Senior Research Fellow Bruce Klingner wrote just last week:


In November 2010, Pyongyang disclosed a previously covert uranium enrichment facility at the Yongbyon nuclear site. Previously, Yongbyon only housed a plutonium nuclear facility. Dr. Siegfried Hecker, former head of the Los Alamos nuclear laboratory, was shown an extensive array of 2,000 centrifuges producing low-enriched uranium. The U.S. scientist commented that he was stunned by the size and sophistication of the facility, which exceeded all predictions of North Korean progress on a uranium program.



Critics charged that the U.S. intelligence assess­ments were partisan fabrications of the Bush Administration, but Hecker’s direct observations of the uranium enrichment facility provide irrefut­able evidence of Pyongyang’s continuing efforts to develop parallel uranium and plutonium paths to a nuclear arsenal.


Klingner recommends the U.S. should:



  • Restore $1.4 billion that the Obama Administra­tion cut from the missile defense budget.

  • Reinstate the original plan to field 44 ground-based midcourse defense interceptors in Alaska and California, rather than follow the Obama Administration’s revised plans to deploy only 30 interceptors.

  • Bolster the Aegis ballistic missile defense pro­gram to accelerate and expand both the develop­ment and procurement of the Aegis weapons system and the SM-3 family of interceptors.

  • Accelerate development of ship-based intercep­tors and the associated fire control software. Upgraded fire control software should then be reinforced by a broader command and control system optimized to support the Aegis system’s access to off-board sensor data.

  • Expand procurement of Standard Missiles beyond current Navy plans to procure 300 SM-3s by 2015. For an additional $170 million, the Navy could accelerate production of these inter­ceptors and build a larger inventory.

  • Give U.S. sea-based SM-3s the ability to intercept long-range missiles in the ascent phase of flight before they can release decoys that may confuse or overwhelm the defense.

  • Fund development of smaller and lighter kill vehicles for the SM-3 interceptors. Increasing the speed of the SM-3 interceptors will expand their capabilities, enabling them to protect larger areas, engage long-range missiles, and intercept missiles in the ascent phase.

  • Invest in research and construction of a space test bed for missile defense. Space-based interceptors may prove to be the most effective and reliable way to counter future-generation missiles.

  • Resurrect the Airborne Laser, Multiple Kill Vehi­cle, and Kinetic Energy Interceptor programs.

  • Consider Seoul’s request to remove the 300-kilo­meter limit on South Korean offensive ballistic missile development to enable South Korean forces to strike any North Korean target from any South Korean deployment area.

Its existing 10-year debt has yielded more than 7 percent in 10 of the past 62 days, according to Bloomberg data. Greece needed a rescue within 17 days of its 10-year yield breaching 7 percent on April 6, while Ireland lasted less than a month after it cracked that level in October.


“Even if we see a successful auction, it doesn’t mean anything, because at rates above 7 percent it’s not sustainable,” said Ioannis Sokos, a strategist at BNP Paribas SA in London. “It is inevitable that Portugal has to turn to the EU and IMF if they keep borrowing at these levels.”


A bailout for Portugal may oblige Germany to end its objections to expanding the region’s 750 billion euro rescue facility, or to bond issues that are guaranteed by all euro members, according to Christoph Rieger, head of fixed-income strategy at Commerzbank AG in Frankfurt.
