Obama - the Black Knight of socialized medicine: "Since Nancy Pelosi's infamous speech in which she stated with that frozen, plastic smile that 'we have to pass the bill so you can find out what is in it,' everything has been bad news. Insurance premiums are increasing even faster than they would have if ObamaCare hadn't passed (Connecticut is seeing a 47% increase this year, Boeing is paring back healthcare benefits for its employees, while even the White House admits that seniors will see higher costs and less benefits, and 700,000 seniors are losing their coverage as a result. Hospitals in Indiana are laying off staff citing ObamaCare. Also, there was this: CNN: Cost of your health plan to rise 14%, the opposite of what Obama promised in runup to ObamaCare), and Obama's minions are threatening insurance companies with bankruptcy for even hinting that ObamaCare is the cause (it is).

The legal challenges that critics dismissed as frivolous now look like they are solid. And Obama is sweating. The exclusive role that the states have always had in regulating their own healthcare, the union exemption that violates the equal protection clause of the US Constitution, the 'Louisiana Purchase' and other kickbacks to states that also violate the equal protection clause. The commandeering of the state legislatures via Medicare expansion. And of course the most infamous of the unconstitutional provisions the individual mandate. The Obama administration has taken to arguing the individual mandate a tax, something Obama angrily denied in the runup to the vote. It won't work (taxing authority does not give the feds permission to use said tax for unconstitutional programs). Obama is now so afraid that different pieces of the law will be found unconstitutional that his regime has turned to the courts pleading for ObamaCare to be severed from its provisions, including the individual mandate. Obama administration officials this week told a federal judge that even if the healthcare reform law's individual mandate is ruled unconstitutional, other parts of the law should be allowed to stand.

That argument, known as severability, is crucial to the law's survival should a judge rule that the mandate is unconstitutional. The administration made the argument Tuesday in a filing in Florida's multi-state lawsuit. The individual mandate is also being challenged in Virginia and Ohio.

'Some limited set of provisions of the [healthcare reform] Act cannot survive' if the mandate is stricken, the administration argues. 'Other parts of the statute, however, are plainly severable from ... the minimum coverage provision.'

...'If the individual mandate is found to be unconstitutional, as Virginia says it is, the whole bill falls,' Virginia Attorney General Ken Cuccinelli told Fox News in August. 'The whole thing.'

The administration acknowledged Tuesday that major parts of the law — including the prohibition against rejecting people with pre-existing conditions and the requirement that everyone be offered the same rates regardless of their medical condition — 'cannot be severed' from the mandate.

Obama must know that the courts will lop off the meatiest parts of ObamaCare one unconstitutional piece at a time, and he's trying to hang on no matter what. I know what he wants to save most - the death panels. ie - the 15 member rationing board (read: comparative effectiveness that takes only 2 things into account - cost and age) first funded under the stimulus boondoggle and the 'Independent Payment Advisory Board' that will decide what is and is not covered. And it's already begun. The Obama administration via the FDA is deep-sixing miracle cancer drugs that extend life because they cost too much (ObamaCare begins early: FDA may pull Avastin approval OVER COST CONCERNS).

The Constitution is simply a stumbling block to what liberals want to do. They go through contortions that make a pretzel seem simple by comparison to argue, if in fact you can call it that, that their actions are constitutional. When asked about the constitutionality of ObamaCare in the runup to the vote, legislators had no answer. Many tried and fell flat on their faces. Some Democrats have given answers to such a challenge in a way that can only be labeled as 'stupid.' Some, like Sen. Merkley claim that two words - General Welfare - let them do whatever they want thus rendering the rest of the Constitution irrelevant. John Conyers claimed a nonexistent 'good and welfare' clause, among other clauses he couldn't name. And then there was Rep Phil Hare, who said “I don’t worry about the Constitution on this” (he should have worried. Voters fired him). Of course he doesn't. Pelosi had a better answer: 'are you serious?' That was it. Sen. Leahy says that nobody questions such authority (I beg to differ). Sen. Warner totally dodged the question by talking about telephones. Sen. Mary Landrieu dodged the question altogether instead referred the questioner to constitutional lawyers! Sen. Blanch Lincoln claimed that the U.S. Constitution charges Congress with 'the health' of the people. Pro-life traitor Ben Nelson (D-Nebraska), who traded the lives of unborn babies for 30 pieces of silver, can't even answer that question before he was re-asked by CNS News. And Sen. Bob Casey is not sure if there's 'a specific Constitutional provision'. Don't you all feel much better now about the Constitutional competence of our lawmakers now? The White House, of course, claims no 'legitimate' constitutional concern. Obama himself said that he doesn't really care how things get done as long as they do. Local cities like Mount Clemens MI are about to go bankrupt because of the increased cost of ObamaCare. That's in spite of the fact that Democrats have abandoned the claim that ObamaCare will reduce cost and deficit. Detroit area health insurance to jump 8.9% in 2011 due to ObamaCare. Texas is considering seceding from Medicaid entirely so they don't go into the red. The establishment media is admitting that you will end up seeing nurse practitioners, not doctors, for care. Insurance companies are being forced to cut coverage plans, the law is creating a huge doctor shortage, is cutting Medicare reimbursement rates thus removing doctors from the system via attrition, and to boot even the CBO admits that it discourages work. Obama's cronies are being exempted from the law via waivers. Every time socialized medicine has been tried, it's been a proven failure. ObamaCare is no different except that it can still be repealed before it's too late.
